Recently separated from my South African husband, i have been forced to hand the keys back to our house as he was not paying towards anything, the house has been sold and there is a short fall of £38ooo pounds - i am thinking of declaring myself bankrupt which would make it revert to my ex partner but he does not have a British passport only a South African one, can he still declare himself bankrupt? He is here on a settlement visa in his passport.

Hi Toni

The insolvency service are cracking down on "bankruptcy tourist" although I am not saying anything negative about your Hubby he will have to proove that his centre of main interest and his debts are predominantly UK based.

if he can proove that he should not have a problem petitioning for his bankruptcy
