What about this scenario?: A married couple with two kids, husband forced into bankruptcy due to legal proceedings. Substantial equity in property but not enough to settle debt. Is the equity split 50/50 or could the wife be entitled to a greater share as the main child carer?

Hi Guy

if one of the married couple has already been declared BR, you are playing serious catch up

if the threat of a creditor petition is looming then get one of the experts to come and have a coffee with you soonest temptation of biscuits may get them to you sooner !!

Your full situation can then be assessed.

Generally it would be 50/50 but if house just in one name & the other person not contributing financiall it could be more than that.
