i have a uk mortage i definitely cant afford as a single mum to a 2 year old,i live in australia as i followed my ex husband here.his name is on mortage but he wont help and want to declare bankruptcy in uk.do i have to return to uk or can my dad represent me?can i declare from australia for uk?

HI Vicki

how long have you been away from the UK ?

you can ask your dad to obtain a lasting power of attorney.

you can fly back and present yourself at the high court

or you can ask a company to do it on your behalf

the process can be quite complex with timings and what needs to be sent to who at what stage, at least one of the experts to the left have a specialist team for dealing with LPA, even if dad is going to petition for you it would make sense to contact the expert.

Hi Richard
Thanks for your help so far.how do I contact an expert & are they expensive?
Is it correct that I must file for BR if I choose to in less than 3years if being in Australia?I've been her 2 and a bit.
I'm unsure what or how to go about it.my aggressive ex husband who is Australian shows no interest in trying to sell the property & split the debt which is what I thought I could do & pay it each month.the house was bought 5years ago at £124,000 & left is £121,000 owing.the value due to recession hitting hard is £94,000.
Every month I'm sending just enough back to keep it afloat but I'm working long night shifts and looking after my 2year old.
I want to move forward but I have put it off for a long time hoping I'd get ahead of myself.the house is in both out names tho he no longer has any rights in uk.
What further advice can you give me? Can I do most of the work on line & get my dad to go in or will I have to fly back? (no money for flight,no care for daughter etc)

The experts are listed on teh left hand side of this page. Once you and dad have spoken tol the expert you will knwo what level of work is involved

yes less than 3 yrs.

you are both responsible for the short fall, if you elect to go BR the whole debt will pass to him.
