my husband and i are in an iva at the moment but due to our son being ill my husband has had to give up time at work and i have spent the last two months at his house as his carer. this has meant loss of pay and two months not paid to the iva. we are now considering bankrupcy due to not knowing how long we are going to be looking after are son. firstly what do we need do do to come out of the iva and secondly as our son can't be left for long can my husband deal with the court etc, or will i have to go as well.

Hi Pam,

Sorry that your son is ill, hopefully he will recover.

If you are both going to declare bankruptcy then I think you will both have to go to court. You don't have to do it on the same day though, so one of you could be at home with your son while the other one went to court.

If you are seriously considering this then ask your IVA company to fail the IVA now so that you can get the ball rolling.

Hi Pam,

Sorry to hear about your son, I wish him a speedy recovery.

As Jan has said, speak to your IVA company as they will advise you on what to do next.
