Hi, I am planning on going bankrupt in the next week but have now recieved a CCJ. On the SOA form section 1.16, just to be clear, where i had ticked no, i am not involved in any legal proceedings! I am assuming that now i tick yes! and add the case number an name of court the ccj has come from? although i dont have a solicitor. Will this make any difference to the bankrupcy? Thanks Anna |

Hi Anna,
it won't make any difference to the bankruptcy, you still list it as one of your creditors, and you can enter it as legal proceedings, it will also save the OR contacting the court to find out who the creditor is (from the experian check they do)

If you need help completing SOA's(statement of affairs) or PIQ's(preliminary information questionnaire) if you've been declared bankrupt, or anything else and you're within 30 miles or so of Warrington, then please contact me via my contact details in the expert page for futher details"

Hi Big Al, Thank you so much! One last question on this subject! For this particular debt which this ccj is for, i am still listed at me old address which is my ex's house. We were together for 10 years not married and my name was not on the morgage nor did i pay towards the morgage. My question is if baliffs went round before i applied for bankruptcy, can they take anything from him? nothing there is mine and i have not lived there for over a year now. Also on the petition section c, where it says, lately residing at! do i put my ex's address? will it have any effect on him? Thanks Anna |

The bailiffs cannot take anything from the address which belongs to your ex and he does not have to let them into the house.
Your bankruptcy will have no effect on him at all.
