Hi everyone,myself and my husband declared ourselves bankrupt last year we were told the OR would be applying for ED and that it should be soon.We filled in new I&E forms and a few days ago i got my ED!!I know i should be happy but my husband never and we have received a letter that says he will have an IPA of 120 pmth and there has been no ED certificate for him:( We had seperate debts as my husbands were from a previous relationship )Im really worked up as on our I&E we only had less than £20 DI so how has he got an IPA? We have done everything by the book and have been totally honest from day one!With the letter regarding the IPA he also received a letter saying they had wrote to him in march and he had not replied regarding matters concerning his I&E but we never received it????What should we do ,i thought things were getting better and it would all be over soon ,its great i have been discharged but we went into this together and have been told a number of times off the OR that everything was fine ,it was very unlikely we would get an IPA and that it would be over by MAY/June time.
Any advice would be really appreciated as i cant ring until tuesday Thanks for your time ..and sorry for going on and on:) |

not at all like that, you have both been put on the ED list as they said, part of the ED process, is that they assess your income again, you have been assessed and dont have to pay one and so have been discharged, the have decided he should and so have sent the letter, the ED wont know go through until the IPA is sorted, They have obviously decided not to accept all of your expenditure if you thought you only had £20 surpus income, if you want to know what they have not accepted the ask them |

Hi thanks for your reply, I am going to ring them but i cant until tuesday because of the bank holiday. We have been thinking and at the time my husband was on a nil tax code and i stated in a note on the I&E form that he was getting an extra 30pwk due to having the extra tax in his pay.I stated this was only until april but thinking about it at the time they would of had to include it i think so therefore it adds up to the 120pmth..I could be wrong but it seems a likely explination.My husband has not signed the IPA form yet until we find out whats what!. (I realise that its all done seperatly regarding both our bankruptcies and all i meant about us going into it together was just the fact that we stick together and deal with it together and we feel like it wont be over until we are both discharged :) As for the I&E hopefully what ive realised about the tax might be the reason for the IPA

Hi Donna,
As Debtinfo has said, ask them what has been disallowed. I've seen your I&E and I'm pretty sure this must be to do with your tax as there is no way you have any disposable income, you live very frugally.

Viki,what do you think we should do about the letter .The clerk has wrote to say he sent us the IPA letter on the 30th of march and that he has not received a reply but we honestly never got it ,if i had of id of rang them to see why or asked you for advice!!!.Could this affect my husbands ED as it says on the copy of the IPA letter that he only had 14 days to reply and as we never received it that time is up and im not sure if we can dispute it.

I'd get in touch and impress upon them that you have not received the letter and see what they say.

thanks Jan,im going to..if i have any letters from the OR i ring them and for something like an IPA i would of contacted them immediatly to ask why, what i am finding strange is the fact that i only spoke to my bankruptcy clerk the other week and he never mentioned anything about it and told me everything was fine????

my worry is that it was the tax but now my hubby has a new tax code so our I&E is exactly what we put on the form and we only had £9 DI.Im worried incase we will still have to pay the £120 IPA as the letter was dated about a day before the new tax year,when we had the extra £30pwk...all seems a bit strange!!! Im going to call him in a bit so keep your fingers crossed for me xxx

Rang OR's office and im not really any further forward he said he just sends the letters and the only thing he can think of is that somethings have been disallowed..i cant understand what as our i&e isnt in anyway excessive,we havent even got anything for emergencys or holidays or anything like that!!! and my husbands wage isnt alot at all.
So stressed just wish it was all sorted ,if it is something that has been disallowed can i say well if thats not allowed can i have an allowance for emergencies as the amount of IPA that he has been given is a hell of alot more than his DI which is only £9

you need to ring back, the person you would have spoken to is probably the case clerk, they just do the admin. You need to ask for the examiner of our case, they are the ones that will have made the assessment |
