Hello there,

I now have aletter from the people who are now the Trustee of my estate. Bridgewood Financial Solutions Limited of Nottingham.

Has anyone experience of dealing with these guys? From what I read in their letter they want me to present a case for my requested exemption of my car. My car is currently valued at £3k but the locks don't work, so I'm currently looking for a quote to replace those. What sort of case would they approve/disapprove? "I need my car for work" might not stick with them, as I only live 3 miles away. The problem I would have is that I work funny shifts, and on occasions the earliest or latest running bus would not get me to work or back home in time to feel safe. In act th last bus is just a matter of minutes and that's it. Walk for 3 miles I suppose - is that what they'd expect me to do? But I also need my car to go to job interviews (I'm looking for a 'proper' job in my area of well paid expertise) and a condition of most job offers will be that you have use of your own vehicle for work :( I absolutely will have to be able to travel to remote locations for meetings etc.

This might all sound trivial I know, but I'd like some advice on how best to present my case to the Trustee.

Hi Widge,
I take it the OR didn't make that decision, as they were seeking an appointment of a trustee other than the OR.

However, as you indicate your argument should be that due to the variability of your shifts, and to remain in employment, public transport would not be practical. Plus as you are currently seeking employment that would provide a higher income, and that the use of a vehicle would be required, you would stand a better chance of securing that employmnent by having the use of a RELIABLE car.

The point to make, is that if they claimed the car, your chances of securing better employemnt would be reduced, and so the possibility of contributing to your bankruptcy estate by way of an IPA, as an IPA over 3 years would provide a better return than simply claiming the car.

Hope this gives you some ideas!

That really helps. You present the case very clearly and I shall certainly emphasise the point about the better paid job/IPA because what you say is absolutely true from their point of view!!!

They also have a duty to get the best return for creditors, simply claiming the car won't!

I received a letter from my Trustee today confirming that he is happy to accept my request for my vehicle to be exempt from the bankruptcy. Hooray!!!!!

I'm really pleased, Al, you really helped with just a suggestion of wording and it means so much to me.
Now I have to provide evidence of what I did with £20k I received from my ex in 2008 (I paid off a loan and some credit cards) - only problem is that the Trusee has all my papers, statements, etc! I'll give them a call tomorrow.

I spoke to my Trustees, who were very nice. They DO NOT have all the statements etc that I handed over to the OR. All they have is minimal stuff and only request certain info from the OR to minimise their paperwork I think. The OR has already not sent the relevant info over to the trustee. ADVICE - keep copies of everything you send to the OR!!!!!!!!!!!!!!

I hope they get this sorted for you very soon.
Fingers crossed that the OR locates the relevent paperwork and forwards it to the trustee asap.
