 Can I declare bankruptcy on behalf of my father ?

My father is 78, retired and has state pension of £650/month & private pension of £70/month.
He has a MBNA credit card debt of over £11000. He is not in the best of health and can no longer service this debt. Can he declare bankrupt and can I do this on his behalf to avoid any more stress for him.?

Hi and welcome.

As far as I am aware he will have to declare bankruptcy himself, not sure if you have power of attorney whether or not you can.

Hopefully one of the experts can help further.

If you have power of attorney (POA) they you will be able to declare BR on behalf of your father. If not then he will have to declare himself.

In reality even without POA you could still do pretty much everything for him. The only things he would be required to do were to sign the form when handing over the fee in front of the BR Clerk and speak to the OR for the interview. You could request a face-to-face interview and attend with your father for moral support. The ORs are understanding people so if you explain that your father is 78 I'm sure there wouldn't be a problem with you attending the interview as well.
