if an IPA has been sent out to be signed but the amount on teh form is so much more than I can afford is there anything that can be done. I am a personal bankrupt and they seem to think I have more disposable income than I have |

This should not happen. You can not enter into an IPA if you do not have any disposable income. I think that you need to speak with the OR. Please come back and inform the forum whether you are working as it may be that the IPA could be made up of contributions that would normally be paid to the Inland Revenue as Income Tax.

Before you sign anything you need to speak to your OR. Have they given you a breakdown of how they reached their figure?

Thanks I am working and I am thinking this may be something to do with tax like you say but will need to check. what then happens at the end of the tax yeara when you need to start paying tax again will they reduce the IPA

Hi,
You will have to pay across your tax to the OR for the time you are on nil tax code. This, as far as I am aware, will make no difference to the amount you pay in an IPA as your tax code will revert to normal at the end of the current tax year.

A nil tax code IPA only lasts until the end of the tax year. Your tax code will revert to normal after that and the only payments made after that will be to a normal IPA if you have one.

HI everyone I spoke to the OR today to ask the question but I have to put everything in writing they can't answer anything on the phone I believe. I actually went BR in Feb so apparently should not be on a nil tax code as this is a new tax year so the figure they have given me to pay is a real figure that I am expected to pay but I really don't have that sort of money left at the end of a month so my husband will be paying which i thought was not correct as he is not bankrupt is it only me. The OR said they work to certain guidelines etc when you fill in the form of your monthly outgoings and I had to include both my salary and my husbands salary and the total household bills but I (me personally) am not left with the figure they are asking for so I am so confused and making me stressed as My husband was already angry about the whole thing and my situation that I got in to but he shouldn't and won't be responsible for my debt and I just don't know what to say.How do I explain all this and not loose my husband in the process.

Your husband isn't expected to pay your IPA. As Debtinfo says you need to find out how they have worked out your IPA. Once you have this you will be able to see what was allowed and disallowed and you can make your case to the OR.

Hi Sarah,
Sorry to hear you're having a stressful time with the IPA. When I did mine, I completed the I&E form listing my income and my expenditures. Some of the expenditures were refused, but for others, I was given more money than I had originally asked for. I didn't have to give my partner's income although I did inform the OR that our expenditures were shared (rent, bills, etc). There is no way the IPA should be more than you can afford after all expenditures have been taken into account. Maybe some the the expenditures you originally asked for were not accepted. Have you checked the final listing they provide you with? When I received mine, it was quite a bit different to the one I had supplied them with. They will definately tweak your original list and sometimes delete some of the expenditures or reduce them but then again increase some of the others (eg. housekeeping).
Hope it gets sorted out.
