Really need some advice here have gotten myself into a bit of a state. I declared myself bankrupt on 5/8/2011. Tomorrow I have my interview with the OR. My worry is that I have been using my current account since the date of the bankruptcy, only for food/travel money etc. The account is in the overdraft. It was only yesterday that I found out I should have stopped using the account from the date of the court order. However, I thought I could use it until the OR contacted the bank and the account was frozen. Do I tell the OR that I have used the account since the court date or just leave it? Will I get into serious trouble for this? The account is overdrawn so essentially I have been using borrowed money whilst bankrupt.
What makes matters worse is that I forget to list a couple of accounts on my SOA. The bank account I have been using is one of them.
What is the best thing to do here? Shall I tell the OR about the account tomorrow and that I have been using it since being declared bankrupt or do I pay the overdraft and close the account without declaring the debt (around £100 overdraft)? I'm pretty sure being honest is the best thing to do but I'm terrified I could get in serious trouble for a) not declaring the account and b)using the overdraft after bankruptcy.
Please please someone give me some advice here I'd really appreciate it.
I would just explain everything to the OR. When I went bankrupt 3 weeks ago, I had some niggling issues with things I had to add to the statement of affairs and it was no issue at all (I had to add an inheritance(i found out after about that), and change some bank details). The OR was perfectly fine about things.
Just come clean, and put everything on the table. Its not worth the worry of trying to hide things.
As randomguy has sad, just be honest with the OR, I'm sure lots of people carry on using their bank account after bankruptcy not realising they shouldn't.
