DESPERATE NOT TO MESS UP my sisters life!!!
My sister was told by the CAB she has to go bankrupt as she is being chased for a debt of £70,000, several years ago we had a joint apartment, she only ever signed the paperwork in order for me to buy the apartment then we stopped talking! she suffered from clinical depression and only recently has she started getting back on her feet, after 7 years, she doesn't need the stress of this and i feel c**P as a told her i sold the aprtment ages ago. weve only started talking again! she is currently studying at university and would like to emigrate to canada after her course finishes next year, what would happen if she doesn't declare bankruptcy, is this the only option she has as she cant afford to pay it. also she lives in council accomodation and at the time said she didnt own any property - because i said it had been sold - i lied because she was on the verge of a breakdownand needed somewhere to live - i couldn't face telling her what a mess of things id made! if she does have to go bankrupt can she carry on with her course - and will it stop her getting a job as a social worker in canada? i now this is a really messed up situation, PLEASE can someone advise? thanks in advance x |

Hi jay75,
Do you still have this apartment? If so, is there any equity? Is she on the mortgage?
If she decides to declare bankruptcy then she can carry on with her course, but she would need to check with the employer re the Canadian job.
I suggest you come clean, chat it all through with her and then urge her to seek advice.

Thankyou for replying
I dont have the apartment as it was repossesed, there was no equity in it. I have come clean with my sister who is not very happy and blames me - i have urged her to seek advice but she has said the man at the CAB has told her she needs to go for the bankruptcy as she doesn't have any other choices, as a student am i right in thinking an iva is out of the question? also another friend has suggested she "ignores" the letter, finishes her course and emigrates - what do you make of this? i understand shes angry with me but she was suffering with mental illness at the time and the last thing i wanted to do was burden her with stuff - so much for me trying to do the best!!! |

She needs to take advice as to all the solutions available and should visit www.iva.com - the advice is free and imartial and all options will be looked at.
The companies are all recommended and the advice is free and impartial.

I'm sure she will forgive you Jay. She needs to chat to an expert to get advice on all of her options. I'm not sure emigrating and leaving all the debts it a good idea, it'll always come back to bite you!
There will be a solution for her so try and not to worry and just be there to support her.

Hi there
further to our chat yesterday, and sorry i did nothave more time, it was a manic day! as i stated yesterday your sister needs to follow the advice of the CAB, and bankruptcy would be her best option, as the debt is not going to disappear.
With regard to emigration, she needs to speak to Canada House and check whether or not being previously bankrupt, may hinder her application to emigrate ( as if she were to file for bankruptcy now, and look to emigrate following her course next year, there is a good chance that she would be discharged from the bankruptcy) She may find it difficult to emigrate whilst an undischarged bankrupt, but once discharged, it may be possible - but only Canada House can answer that one.
Try to have a chat with your sister, come clean with everything that has happened, i know this is going to be difficult, having chatted to you previously, if all else fails and a chat is not possible, why not write and state exactly what has happened and when etc - if she chooses not to read the letter, sobeit, but at least you have tried. Try to leave the letter to just stating what has happened, leave future advice for her to follow out of the letter - that is for her to receive (from the CAB/Canada House) try to remove yourself from that position. What has happened , has happened, you cannot change anything, but let her make her own decisions and get her own advice as to her options
That is all i can recommend, and again, sorry i could not chat further yesterday. All the best of wishes to your future, you really do need a break and try to istance yourself, and hopefully, move on, i appreciate with your family poasition that may seem difficult, but it willbe possible for you to draw a line under everything, if you accept and tell yourself, what is done is done, you are sorry, but you cannot change what has happened, and try to look towards your debt free future x
