I was declared bankrupt in May 2008 The OR was happy for an early discharge but the IP of my previous IVA insisted on becoming my trustee. I was unhappy as I had been advised to put in a complaint about him but this concern was ignored. I had only heard from him once in Jan 2009 asking me to fill in a load of forms. I have today received a letter (over three years after being declared bankrupt and over two years after discharge) requesting details of cheques written (I owned a pub so I wrote a lot of cheques) I have absolutely no idea what to do How many years after bankruptcy can this trustee continue to ask for information? I thought it would all be over with by now. Many thanks
They have asked me for details of two cheques and invoices. All of the invoices were given to the OR and I have no idea what the cheques were for. I wrote dozens of cheques per week for a period of 10 years. I'm not sure if the OR has sent all of the paperwork to the trustee so I am going to write to her to ask her. In the meantime the trustee has sent another letter asking for an urgent response. Feel like this will never end. Aaargh!
I was considering doing that but the I thought that might be considered un cooperative. I am sure that he only asked to be my trustee in order that he can prevent me from putting in a complaint about how he did the IVA that failed. I was advised to put in a formal complaint but the guy owns me now. He has the power to cause me problems and there is nothing I can do about it. I thought maybe there was a 'timescale' for him to complete his investigations. It would seem that I wil be jumping through fiery hoops for the rest of my life.
The trustee has requested details of two invoices and cheques to which you have stated you have no idea as you issued many cheques each week. You also stated that details of the cheques were delivered to the OR. That is therefore your co-operative, and honest answer which should be put in writing in response to the trustee, which puts the ball back in his court.
Putting aside your issues with the Up (you can still complain if you feel you have a case) then it is reasonable for them to ask about 2 specific cheques. What they will. be looking at is if you have favoured a creditor particularly a friend or family member, does that ring a bell
The problem is that I have absolutely no idea who they were for. They definately weren't for a friend or family member. It was such a long time ago and the invoices were given to the OR. I have written to the OR to check that they sent all of the paperwork to the Trustee. The OR wasn't very good, in fact they took away my car in 2008 (it wasn't running or insured) and last month I had a debt collector demand for taxing the car in 2009. Obviously she hadn't completed the paperwork to say that I no longer had the car. I will wait to hear from the OR and then respond to the Trustee. I just wish he would go away and let me get on with my life.. I should stop stressing but I can't...Aaargh!
