| I left a violent marriage 12 mnths ago and now live with my parents n my 3 kids. I had a flat in my name that was forced to buy and then when i cdnt afford the mortgage as i hv had to quit work my flat was reposesed I was adv by debt line to declare bankruptcy. Ipaid £750 7 mnths ago and it is still not regustred. I get told to wait as theres a back log. But the c tax £700 is on the creditors list n they are sending bailiffs to my parents house. Wat can i do? Im v stressed n my parents are old and heart patients. Why is it taking so long and wat cani do??? Pls help me. Ranj |

Hi and welcome.
Firstly, I am so sorry about the trouble you have suffered.
Firstly, your parents stuff cannot be touched so don't worry about that.
Which company did you use for assited bankruptcy? Does not sound good at all.
There is not that much of a backlog on bankruptcy.
You can do BR yourself and it will just cost you £700 at the moment.

Hi and welcome from me as well.
I'm sorry to hear about the problems that you have had.
As Jan says bailiffs cannot touch anything that belongs to your parents so please don't worry about that.
From your post I take it that you used a BR assist company? Would you mind telling us which one as it sounds as though the service you have received has been very poor.
Speak to any of the experts who post on here and they will be able to give you advice about your situation. Their details are in their profiles, and also in the experts link at the side of the page.

I am so sorry to hear of your plight and it sounds as if things have not become easier.
There is really not much of a back log to make yourself bankrupt. In certain County Courts, you may have to wait two to four weeks to get an appointment but that should have been made for you as it sounds as if you have paid for a bankruptcy assist service. For that sort of money, the company who you instructed should have made an appointment at your local County Court, helped you fill in the bankruptcy forms and perhaps accompanied you to court.
You can apply for your own banktruptcy and in certain areas, there is not much of a wait.

ref court backlog
some courts offer drop in services with no backlog
others are about 6 weeks in arrears
if in doubt telephone the bankruptcy clerk at the local court they will point you in right direction.
Make contact with one of the experts on this forum they will help speed up the process and get you back on the right track.

Ranj, if you have paid the money to a bankruptcy assist company you really need to chase them to find out what is going on. It's not good enough to take your money and then not bother with you.

Thank-you for your helpful advise. The company I used was debt help direct. They pushed me to pay the full amount in the first week and they assured me this would secure a date faster with the courts. This was back in March. I have an outstanding council tax bill and the bailiffs are threatening me with coming down and takings parents belongings.
Is there anything I can do to speed up the process, and stop bailiffs. In the circumstances I left me and my kids have only the clothes on our back. |

Did you had a telephone/face to face meeting with debt help direct? Did you have to send them any paperwork? Have they completed your court papers for the bankruptcy? What have they actually done so far?
I advise you get back in touch with the bankruptcy assist company and if they haven't completed your forms and they themselves have a backlog! then get a refund and do the forms yourself. Phone the court and book yourself in, it may be that you can get in within a couple of weeks.

I presume the council tax debt relates to the house you had with your ex?
Bailiffs cannot touch your parents personal belongings at all and if they come round, do not let them into the house. Make sure doors and windows are closed and locked as well as they can get in that way.
You do need to chase this company and see what on earth is happening, especially as you have paid upfront.
