 What are the implications of filing for bankruptcy from Canada ?

I am a Canadian that lived and became resident and a British national. I recently moved back to Canada with my wife and 3 young children.
I foreclosed on a house that I could not sell and also left behind an unsecured loAn, everything totallinga £80,000! I have been recently sent a letter from the unsecured debt's lawyer that I need to pay it back!
I have no assets in Canada, my wife is not working my current salary I $70,000 per year.
Can you tell me if I do file foqr bankruptcy in the uk, can you give me an idea of what I will have to pay my creditors and for how long? And do the UK courts have to abid by some of the Canadian rules?

Hi and welcome.

You would have to file for bankruptcy within three years of moving from the UK. It means you either coming back here or appointing someone to do it for you.

As to repayments, it will depend upon your disposable income as to whether or not you have to pay anything across.

Hopefully one of the experts can help further.

Hi Jody

research lasting Power of Attorney,(money not incapacity) I think Mel one of the experts is able to help.

I am at court with a number of LPA's lots of differences between what is written by the courts and what actually happens, so take thorough advice.

You would either have to return to the UK to file, or as stated you can appoint a Power of Attourney to do the process for you.
