I'm in an IVA and can't afford to continue making payments, so am considering bankruptcy. My question is; would this affect our house as the mortgage is under his name (everything is in his name) but I may be named on the paperwork.
In the first instance it would be sensible to speak to your IP to hold a review of your situation - have there been any changes to income and expenditure etc since it was set up, if so the changes could be incorporated to your figures and perhaps reduce your payment into the IVA.
If you did decide to file for bankruptcy, you would have to speak to your IP as your IVA would need to formerly 'fail' before you would be able to file for bankruptcy
With regards to your home it all depends on whether you have any 'interest' in it
