Hiya,
My partner has been made bankrupt recently and needs to go and see the official recievers. In a typical man style, he left all the paperwork til last minute and then panicked, and is now ULTRA stressed! I've got a few questions and would be really grateful to hear from people who've been in this situation before...
1) He's a plumber and needs his van for work, but has only paid £6000 out of the £26000 that it cost. Will he loose it? He's lost his liscense, so a collegue is driving it for him (all insured and everything etc)not sure if that makes a difference?
2) Will the bailiffs take any of my stuff? Because I'll be SOOOOO angry if they do! I have a laptop that I need for college and am scared they're allowed to take it.
3) If you hide items from the bailiffs (eg asking a neighbour to look after them), I take it that's illegal?
4) Should he get a solicitor involved before he goes to see the official reciever? If so can he get legal aid?
5) On those forms, does he have to claim my spendings/earnings? And how he has to support me (I'm at college full time and only have a saturday job bringing in £140 a month... which won't even cover living costs!)
6) He and his dad started up a new company together back in May after both their buisinesses started to fail (all due to the recession)
7) There's so many things he's worried about getting arrested for, that he thinks he's done. Like he's been a director of the new company (but stepped down as soon as he realised he couldn't)blah blah blah. Has anyone got a list of things you CAN be arrested for?
I know it sounds a lot, but he's really stressed and it would be nice to be able to tell him not to worry SO much! Could you just give us the worst case scenarios?

Hi,

1. Is the van on HP? or a loan? If it's HP the HP co will probably terminate the agreement and want to reposses the van. They may not though so it's best if he speaks to them. If he needs it for work then depending on the monthly amount he's paying it may be an allowable expenses. If it's a loan, then it depends on the value, he may have to sell it and get a cheaper vehicle.

2. You laptop and stuff will be safe.

3. Which bailiffs? Have you had bailiffs visit? If you mean the official receiver, then they are unlikely to want to visit your home to take anything unless he has something expensive to hide.

4. Not really needed and probably not.

5. They will want to see that you are contributing your fair share to the household bills etc.

6. He can't be a director or involved in the management of a limited company.

7. There won't be any arrest made unless he's done something illegal.

I'm sure he'll be fine so tell him to just co-operate as much as possible and I'm sure it'll all be over quicker than he thinks.
