Hi,
I have just received a letter from Capquest regarding outstanding Student Loans from when I was at university in the early 90's.
On 1st June 2003 I was made Bankrupt and as such assumed that my student loan debt would be included and 'cleared' as part of the bankruptcy.
I have read that bankruptcy prior to September 2004 would have included student loans - is this correct and if so should I simply call them to tell them this ?
What details would I need to provide to them ?
Thanks,
Mike

Hello there

as far as I am aware student loans taken out pre 1998 are included in bankruptcy. Any student loans taken out after that date cannot be included and the individual is still liable for the debt.

Hope this helps, Melanie

Apologies, I went away to read the technical manual.... any Student loan prior to 1998 CANNOT be included in bankruptcy.

For the period between 1998 and 2004, there was a loophole with the new loans and they could in fact be included in bankruptcy, IF they were taken out during this period.

Any student loans post 2004 CANNOT be included in bankruptcy.

Again apologies, as I posted the reply, I started to doubt myself, went and read up, and duly slapped myself on the wrist! and posted this amendment

Hope this clarifies things for you mike.gh
