 Can court or creditors refuse my going bankrupt ?

I'm 23 years old, full-time bar staff and in roughly £16,000 debt to around 6 creditors. My partner is awaiting major lower leg surgery so, for now, I'm the sole breadwinner and will be until his physio is done. We don't know when or if he can return to work. If I declare myself bankrupt can the Court or my creditors refuse to allow it to go through? Getting the £700 will be hard enough, without the chance of it being declined. Thank you in advance.

Hi Katie,

I suggest you take advice from an expert on here or visit the CAB to go through your situation and see if bankruptcy is your best option.

If you have taken advice and are insolvent, then there is no reason the court would reject your bankruptcy.

From your posting I can see no reason why the court would refuse your bankruptcy at all. You do not qualify for a DRO and from the tenor of your posting you have no DI, so couldn't consider an IVA or DM. You are entitled to go bankrupt if you wish and so you may proceed without fear.

I very much doubt that you would be refused. Just stop paying your creditors and save that money for the BR fee.
