| For anyone worrying about their impending appointment at court this is what happened when i went today. There was 6 of us sat in a small waiting area all had a 9.30am appointment. It was like being in a doctors waiting room. Anyway at 9.30 a guy opened the insolvency window which was next to the bailiff window and as i was first i went up. He quickly flicked through my forms, which i duly signed etc, then i had to swear the affidavit, i might add at this stage that all this was occuring in front of all the other people behind me, i wasn't whisked off to a seperate room or anything just had to stand there in front off all the others(who could hear and see everything)and go through it all, very impersonal i was thinking. anyway, his colleague asked me for the 495 bucks, after he'd counted it, he said that i should come back at 11.30am and he'd have my bankruptcy order signed and sealed by the judge and ready to go. When i came back after aimlessly wandering around town for an hour and 45 all the people had returned or stayed im not quite sure, only 1 person had to actually see the judge and that was because he owned a property, presumably the judge to be sure he knew what he was doing. Then another of the staff called out our names individually freom the window and as we went up she just handed everyone their B/orders and briefly said that the O/R would phone us within 48 hours or so to arrange the O/R interview. And that was it, done and done,so as you can see theres nothing to stress or worry about at all, as long as youve filled your forms in properly and not left anything out then the whole process is perfectly simple. My over riding thought as i left was how easily the judge had earnt his/her probably large cut of our bankruptcy fees, money for nothing for your honour. The O/R interview will be slightly more tricky for me as my debts are probably inexplicable and im hoping my co-op cashminder wont be frozen or anything silly like that, i havent informed the bank or any of my creditors yet(wether i should or not i dont know). Anyroad, that bit of the process is very easy and nothing for any of you out there who are going to court soon to worry about. |

| Cant afford to take a day off in the week Julien and the price of diesel for me to get to london from bristol would be scary. As i go through the next couple of processes i'll post it on here, that will be the way i can contribute, unless of course youre offering an all expenses paid trip to london with reimbursement of loss of earnings and maybe some dancing girls and a free bar thrown in..?... |

I assume that this was Bristol County Court? I use Bristol a lot for winding-up petitions, and have to say I find they operate a very efficient and sensible system there.

| Yes Melanie it was Bristol C/C, and on the whole i would say that i agree with your description of them. I imagine that large city county courts get lots of petitions and other things, so to keep things moving it makes sense that most straight forward cases dont need to see a judge etc. Presumably smaller county courts in more rural locations would have more time to adopt possibly more stressful procedures for individuals. Give me the straight in and straight out busy county court any day of the week. Its possible i'm hoping that the city O/R's will be equally as busy and try and turn cases round just as quickly, possibly people in quieter areas would come under a much more powerful microscope than us in busier locations. Not that i would wish to imply that some O/R's dont do their job properly, but time constraints could play a factor. |

I've always found the courts and OR offices (irrespective of where they are in the country) to be highly efficient and provide an excellent service. Nice to know the system works :)
