Yes he is still in his bankruptcy period he will be discharged later this year, he is paying an IPA which is for 3 years. The issue that we are facing is that we have a baby on the way and I would like us to live back together as a couple which I don't see as an unreasonable however his OR seems to think that just moving in with me isn't a change to his circumstances as we are not married and that I have been able to cope financially bearing in mind I will be on SMP which for me is a big drop in salary, I wouldn't have thought that we would be penalised this way as we are not a married couple. Has he been given incorrect information?

if you move in to gether he should fill in a new income/expenditure form which includes both your incomes and expenditures, for some people that would mean paying more, for some it would mean paying less depending on their circumstances
