Can you still be chased for debts that are six years or over? What rights do you have if after such a time you are receiving demands for money?

Hi Susan,

It depends on what the debts are, certain ones are 12 years and I don't think court fines are included.

If you have acknowledged these debts at all in the last six years then the time starts all over again.

Hi Susan

I think you are asking whether or not the debts are statute barred after 6 years. If you have not contacted the creditor or made a payment for 6 years then they debt may well be statute barred. This means that the creditor can no longer use court action to enforce it. As such they might as well write it off.

However as Jan says some debts are not statute barred after 6 years particularly if you have made a payment within this time or acknowledged the debt in any other way. Aletrnatively if the creditor has taken a CCJ out against you the 6 years starts again from the date of the judgement. Mortgage shortfall debt is not staute barred until 12 years have passed.
