i am cosidering bankruptcy,i have for the last 8 years had a private lease where i obtained a premises license and carried on trading as a bar /night club, how will this affect me in regards me transfering it to a new owner,ie;is there a time limit, or can they surrender my license as a result of my bankruptcy, the reason for my concern is the landlord may want to keep the license to uphold new interest |

Hello there, and a warm welcome to the forum
With regard to your query - a 'premises licence' held in your name would be lost on the making of a bankruptcy order against you, However, if you had a personal licence then that is dealt with differently in that you may be able to retain it, though you would have to check this out yourself through your local Licensing Authority. (there can be variations between authorities)
With regard to time limits on transferring the premises licence, again you would need to do this prior to the bankruptcy, but I would still check with the local Licencing Authority whether or not you are able to transfer a premises licence, or in fact the new proprietor would have to apply for a licence in their own name.
