I own a home in Spain and I'm upside down on my mortage. I have moved back to the UK and I'm living in rental accommodation. I have been trying to seel/rent the house in Spain for two years and have been unable to sell. I can no longer afford the mortgage payments. I do not have a job. Can I declare myself bankrupt and hand the house in Spain over to the bank?

how long have you been back living in the UK and is there any equity in the property in spain, do you have any other assets or debts

The guy in front of me this morning was a solicitor and had only lived in the UK 2 months.. He was declared bankrupt same time as me.

Just wanted to say! :)

::edit:: although he may have just fired himself according to the government website :/

I agree with Viki that you should speak to an expert for some free advice.
