Thanks for your info. I have been looking all over the net for this. I keep getting conflicting information. So far as I can make out you can include them in a bankruptcy but they can then refuse to pay you if you claim that benefit again. Seems ridicilous to me but we are in U.K. So ridicilous seems the norm. I am currently under investigation for not telling them my health condition had improved making me not entitled to D.L.A. My condition has in fact worsened. For some reason they believe rheumatic arthritis gets better. I am also in an I.V.A. which is paid for from D.L.A. payments so if they stop the D.L.A. I have no alternative but to go bankrupt. Great country we live in do we not. I paid tax and worked right up until I became ill when not only did I have rheumatoid arthritis I also had a number of strokes. As soon as I became ill the whole establishment began attacking me and have not stopped since.
ps you would know if they are considering fraud because they would interview you under caution, if they dont then it is not likely to be consudered fraud although they could still ask for repayment, in that case if the final decision to ask for repayment was before the bankruptcy order then it would be included in the bankruptcy
Yes it is interview under caution. In the letter they say because I have not notified them of improvement in my condition. I wonder if that is because I have had a new hip and not said but I do not know. It is ridicilous to say rheumatoid arthritis has improved. The truth of the matter is when you are given this help you are immediately suspected of lying. Every time there is an election you are dragged in again to be asked the same questions in a slightly different way to try and get your claim ended. This latest lot are ending D.L.A. as you will know so I will be called in for that one anyway. The government have said they will find 40% of claiments not entitled to claim. How they can say that before investigating I do not know. Point is I am fed up of it. I need the D.L.A. to help towards the I.V.A. If I am not getting that I just haven't got the money so what the hell Bankruptcy here I come.
