Hi all
Just to update you, as most of you are aware we had to go to court on Monday (18th June) for the trustee's claim for possession and sale.
As we were fully aware our 12k offer was not acceptable.
So the judge ruled in favor of the Trustee and gave us until the 3rd August to move out of the property.

We have had no contact from the Trustee yet, does anyone know what happens next? I understand we have to sign forms. What happens if these don't arrive by the time we have to leave?
Will he want the keys back? I read somewhere that I lock up and put the keys back through the door?
We have decided that we will be leaving a week before the 3rd august deadline, we have been able to find temporary accommodation ( friends sofa) so we will be leaving on the 27th July.

I would like to thank everyone for the good advice on this site, but also I would like to point out that there was some misleading advice. I guess with a forum full of strangers not knowing the full details, this can happen.

We have been looking around for a property to rent, sadly the advice I received about Agency's having no problem was in fact untrue, we have been to 8 Agency's, viewing 4 houses, we told them all up front about our situation, 2 agency's just hung up on us, 2 agency's took a note and promised to ring back, 4 weeks later we have heard nothing ! 3 Agency's said it wouldn't be a problem, took our credit check fees, £40, £55, and £75 and then promptly came back with "you have failed the credit check" We lost that money as it was non refundable. The last agency was or seemed more friendly, but the property he was offering had an Asian couple living in the adjoining garage, and we were expected to cover the cost of their utility costs.
So the hunt continues.............

Sorry to hear your offer wasn't accepted.

I'm sure it can't be as simple as popping keys through the door, as you'll want utility readings to cover yourselves against the possibility of false claims.

Sorry also to hear some advice was incorrect.

Hope you find somewhere suitable soon.

Sorry to hear of your problems - try a private renting, you may fare better there.

I would never recommend paying upfront for a rental if you know that your credit rating is shot as you will never get the money back.

I think you can just hand the keys over but I would take note of utility readings - photograph them if needs be so you have proof.

You could of course arrange to meet whoever is due to take over the property there, handover the keys with a signed agreement including all your readings.

Belt and braces, and all that type of stuff ;-)

And of course do not sign anything until you have read it through thorougly and are happy with what it says.

Belt and braces,

Write your own form that says how many keys, and who has signed for them.
Take your own readings, and get the person who signs for the keys to sign that the readings are correct.

Thats what I was alluding to Niobe.

Just to add, thats a common thing to be done on handover of properties.
