Sadly I am awaiting my certificate of failure from my IVA company after it failed due to my redundancy and the need to give up my job search to care for my father full time after he had a stroke.

My question is:

I was named on my father's current account (name only) and never issued with a debit card. My father wanted me to be on his account in case anything happened to him many years before. I never used the account as it served to only pay in my father's pensions and I had my own account. However 20 months ago I made the decision to take my name off his account as I did not use it. I will declare this on the bankruptcy forms but worried that they will take my father's money (he is 90 years old and never been in debt).

Please could you kindly advise me.

Hi and welcome.

If you no longer have a joint account then there will be no problems with your fathers account.

I don't see why you need to declare this on the forms as it is now just your fathers account.

May I ask another question please.

Once I get my certificate of failure, I will call the court to arrange a date (in my area is is approximately 1-2 weeks). However I am really scared that I will be bombarded immediately with phone calls and letters from my creditors prior to my court date. Should I tell them I am going bankrupted?

You may well get calls but if so, just tell them you are going bankrupt - they can't do anything else to you.

Hi JeanetteK,

Were you just a signatory on his account or was it a joint bank account?

If it was a joint account then you will need to list it down in the bank account section as you have had the account in the last 2 years, but you can add a note at the bottom of the statement of affairs about the situation and also tell the OR.

As you haven't used the account, it won't be at risk.

As Niobe has said, you can tell your creditors you are declaring bankruptcy, or just ignore them.

Hi

Thank you on our response back.

With regard to the bank account, my father was issued with a debit card only in his name and I was never issued with a debit card. However both our names were shown on the cheque book.

If you are no longer on that account then I don't think you have anything to worry about.

Its always easier to get seperate accounts.
Let us know how you get on,and who you went through for future reference for all.
