Hi All i have a query about when an ipa is set up.I went bankrupt april 2012 and no ipa has been set up. i pay my tax ipa.but no other payments. I have asked about this at my interview (telephone interview) i was advised that they would look into this. Since this i have asked a number of times and have been advised that they will look into this about 6/7 months into bankrupty. 1-Why does it take 6/7 months when i have given details on i&e and have offered to pay what little i have left to OR. Is this the normal process as i know its for 36 months and would like to start paying sooner rather than later. Dont know if it helps but i have 6 children and work but on a low income i get child tax working tax and also child benefit. Thanks for any advice. Gems31

How much disposable income do you have a month after all of your bills have been paid?

Hi I have about £56 pound if that left each money.I throught that no matter what you had left that the OR requested it.?
Do they leave everyone 6/7 months before looking at a ipa or possible ipa.I was just abit worried that they would say right we want ipa plus 6/7months.I have not saved it as i have needed it so really worried where i would get the money to pay them. Any advice or what other people have been through would be great.
Thanks

As it's more than £20 then the OR will take it. If you're paying income tax then you'll get a nil tax IPA for the rest of this tax year and then you'll get an IPA for three years.
You may find that when you go through your I%E with the OR you don't have as much DI as you think you have. Make sure you put down everything you spend, don't forget things like prescriptions and dental.

Hopefully Viki or Debtinfo will be confirm whether benefits are taken into account for the purposes of an IPA.

Only when the last tree has died, the last river has been poisoned and the last fish has been caught will we realise that we cannot eat money.
Last IPA payment made on 28th June 2010 and I'm now looking forward to getting married in September 2012 - I'm proof that you can go BR and come out the other side. |

Hi gems31,
As Niobe has said, you may get an IPA if you have a surplus of £20 or more at the end of the month. All your benefits and your wages will be used for the calculation. However, it could be that you didn't account for all the needs of your large family and the OR has done.
There is no reason to wait for 6/7 months if you have disposable income now so my guess is that they have calculated that you don't have any disposable income and they just want to reassess your situation again.
If you really want answers then give them a call.

Hi Gems31,
To answer one of your worries. If they do end up putting an IPA in place at the 6/7 month point, it doesn't get backdated. It would run from the date they put it in place.
As has been said, it could be they've decided not to put an IPA in place. Its normal to wait until later in your BR process to find out, and often after you have been presented with a second income and expenditure form.
Its probably worth a look at some previous recent threads where a poster listed all the allowances/expenditure before their own IPA. (taking in to account differences between personal circumstances).
-------------- Views expressed are my own personal views, based on what has happened during my own BR process unless otherwise stated. Professional advice should always be sought. |

normally they will send the IPA paperwork about 8 weeks after the bankruptcy date if they have decided that an IPA is appropriate, if they dont think an IPA is at first appropriate they make a second check later on after about 7 months |
