hi i have a rented property which i can no longer afford as i cant get it let and the property value has dropped so much selling isnt an option, i have a low income and live with my parents. i have a joint morgage with my ex as she couldnt get a morgage on her own, she lives there with our two kids. if i go bankrupt will they touch my kids home. |

Hi Rachel and welcome to the forum. Is there any equity in the property your children are in? Have you been to your local CAB for any advice?

Last IPA payment made on 28th June 2010 and I'm now looking forward to getting married in September 2012 - I'm proof that you can go BR and come out the other side. |

If you read the post we were waiting but pcoventry's comment wasn't appropriate, hence the replies from Niobe and myself. Hopefully the OP will come back and answer any questions that have been asked.

How much unsecured debt do you have? How much equity is in the property roughly? Can your ex afford the mortgage payments on her own?

Personally, I dont see that the sex is relevant. I was under the impression that Debtinfo was trying to establish whether it was a Civil Partnership/Marriage or purely a Common Law partnership. |

The answer to the original question depends on if the property is a sections 283a family home or not which is subject to the below clause which is why my question is pertinent
(c) That dwelling-house was the sole or principal residence of the bankrupt, the bankrupt's spouse or civil partner, former spouse or former civil partner at the date of the bankruptcy order. |
