banktrupcy and restriction by land registry.4 years ago when my partner and I separated we had the property transfered into my name. I have since paid the mortgage in full with my pension. i am now the sole proprietor on the deeds, he agreed the transfer without any payment due to his lack of contribution to the mortgage etc. but there is still a restriction --"No dispostion by a sole proprietor of the land (not being a trust corporation)under which capital money arises is to be registered unless authorised by an order of court" Does this have any implications for me should my ex-partner become banktrupt, as I believe this is about to happen.Just found out this refers to a "Declaration of trust" EX-Partner provided the deposit for the house-£19,000.it states that upon sale of property he gets this money back.Can the OR claim it? if so now or if I sell the house at a later date? I have already bought his ben. interest from a previous banktrupcy!

Hi Angela,
When you bought the beneficial interest, was that to a seperate property to the one you are talking about now?

It would definitely be in your interest to seek some professional advice about getting that clause removed.
