Hi, I am in debt to a total of £32446 split between seven creditors,When I had to cease trading in my garage in November 06 I wrote to all my creditors and have been paying them all £5.00 per month hoping things would change. I am now 69yrs old and and cannot afford to go bankrupt I have no assets and live on a pension credit and housing benefit ect. What I would like to know is do I have any other options, also all the debts are in my name only, if I was to die can the creditors hassle my wife, Hope you can help me.Thank you.
Regards J Denniss.

Hi,

There is no other option other than bankruptcy and I doubt your creditors will do it for you.

If you die and you have no estate then your debts will die with you and they cannot hassle your wife.

Hi Jum,

As Niobe has said, if you have no assets, the debt will not fall to your wife if anything were to happen to you.

It does sound like bankruptcy is the best option. Regarding the court fees, I suggest you make an appointment at your local CAB to see if you are elligible for funding to help with the fees.
