Can anyone tell me why in the world do the Trustees want me and my husband to vacate our property, even though it’s not yet been sold?

I was made BR just over 3 years ago (husband not) and house has been on the market for almost 2 years. A buyer was found, but eventually decided not to go ahead. There have also been a number of viewings since the property was first marketed.

A couple of months ago, we both had to agree to sign a Consent, which went to Court, allegedly agreeing, and in order to protect the Trustees' interest, that if needs be, the Trustees could obtain sale and possession – at the time, the proposed buyer was still active. Last Friday, I received a letter from the solicitors acting for the Trustees, giving us 14 days from the date of the letter to vacate the property – BOXING DAY! I telephoned the Trustees’ office to speak to the person who has been handling my BR, only to be told that he “wasn’t around” at the moment (no explanation given) and my matter was being dealt with by someone else, who was supposed to ring me back. I eventually spoke to the solicitors (Trustees had obviously contacted them).

I have also spoken with the Estate Agents, who have also been good enough to liaise with the Trustees/Solicitors and I am waiting for confirmation that we can remain in the property at least until after the New Year. Obviously, the logistics of the particular 14-day time-frame are not practical.

Apparently, it seems that the Trustees want to take over the management of the sale of the property, but no-one – not even the Agents – can make sense of the fact that they want us out of the property. The property, unfortunately, needs quite a lot doing to it (lack of funds dictates!!) and by leaving it empty, especially at this time of year, is totally insane – I don’t believe it will sell any quicker just because I’m not there. Regrettably, too, the particular part of the country in which we live is a very depressed area and so, of course, it does reflect on the property market as a whole. The Trustees have not instructed alternative Agents – well, not so far as I am aware.

Because my husband was not made BR, he is considering challenging this action – we have already sought some legal advice on this.

Sorry for the long diatribe, but if anyone can give us a valid reason as to why the Trustees want to throw us out of our house (there is a mortgage on it which is not in arrears but would be if we weren’t living in it), I would much appreciate it.

We have done everything they asked of us.

Sorry to hear of your problems, not what you want at any time of year but especially not at Christmas!!

I have no idea why they are doing it but hopefully either Viki or Debtinfo will be around later to advise.

Thanks Niobe. Definitely not in the Christmas spirit!! I omitted to say that I think that we've been misled. Something to get our teeth into in the New Year!

That's really awful bearsndogs. Sorry, I can't help, but maybe debtinfo has experience of this situation, hopefully he'll look in soon.
