My partner is threatened with bancruptcy am I liable for the debt and can the bancruptcy be levied against my goods and vehicle. I am the sole earner and have very little to live on after weekly costs have been paid.

Has your partner spoken to an expert regarding debt advice?

Hi Niobe and Viki,
The debt is my partners alone she is "a homemaker" does not recieve benefits of any kind. The only "assets" are tv sky box and dvd player and computer there are no savings, the house is rented and my vehicle is essential as I work 12 miles away from our home. Will my partner be the only one bancrupt or will I be included in the bancrupcy.

It will just be her involved in the bankruptcy.

Agree with Viki - if you have no joint debts then you won't be liable for anything. The Sky box, computer and dvd player will be fine

The company involved is called Capquest who say they purchased the debt from Shop Direct. The total amount is for £1325.4. A statutory demand has been sent stating 18 days to settle or 21 days bancrupcy proceedings will commence. My partner does not know either of these companies or has to her knowledge had any dealings with them.

Capquest will have purchased them - most companies sell on debts once creditors can't pay.

I would be surprised if they commenced BR proceedings as it will cost them an awful lot of money to do so.

cap quest very rarely go to court, they write letters that are intimidatory and use lots of wordings like May, consider, might, horrible bullies.

however if you can speak to them and find a common ground you may be able to come up with a minimal payment plan

A payment plan is not a solution it is a method that allows you to buy time,

dont expect too much from the operative at the other end of the phone. They are paid to collect money as much as they can, they do not care that much about you and your circumstances.

you need to sit / talk with someone and work out a long term plan for all of the debts. the amount owed will dictate the options available to you.

CAB are good but you may have to wait for an appointment some local churches or councils have money talk / money guidance schemes.

If your partner has had no details with Shop Direct then she needs to speak to them to find out what is going on.

Has she bought things from companies such as Littlewoods, Kays, Very, Isme? The list is quite long so I would check up on the Shop Direct website to see if she recognises any of these companies.
