Can anyone help please? I had to stop paying my IVA in Jan 2011 as i had a bad accident & had to leave work, i decided the only way to sort myself out was to go bankrupt, my mum paid a solicitor to deal with all the BR p/work & go to court on my behalf as i was a real mess, i'm on anti d'sants since last July & saw a counsellor for nearly 1 year,due to being in constant pain, stressed & worried sick about the future. However my solicitor couldn't proceed with the BR as Grant Thornton had to terminate my IVA,I only received the termination p'work a few weeks ago from them,I had seen the solicitor last august, done my I&E & SOA but circumstances have changed, i have a final meeting with them on 29th July to re do new I&E & SOA.I stupidly took out 2 payday loans to help me cope when my partner walked out on me & i've paid them off as i couldn't include them in the BR as i have a co op cashminder bank account where my ESA payments go.I'm in such a state over what the OR will say & do re the payday loans, I know i was silly but when you're desperate!!I'm in tears writing this,also my mum is elderly & as an only child i know i will inherit her house god forbid should she pass away, she has a clause written into her will that during my BR her assets are held in trust by the solicitor so they cannot be used to pay my debts,i know should anything happen to her after i'm discharged the OR can't touch her assets but i'm panicking in case of my stupidity he will make the BR last longer than the year, also i've a grt landlord, never missed a payment,& i'm debating whether to tell him i'm going BR as i know the OR will,I'm in such a state & i don't know what way to turn, I've debated taking an overdose as i just can't cope with all the stress. Iv'e read posts here where the interview with the OR hasn't been as bad as people feared they've been understanding & sympathetic, can anyone give me a personal view?

Hi Holly,

Please don't fret, it's not going to be as bad as you think. I've dealt with lots of people who have had to take payday loans as a last resort just to keep them going.

Get yourself to court and get it done, and visit your GP again and tell them how you are feeling.

I presume you are getting advice from the people you have appointed to help you, so talk the house through with them so you understand exactly what will happen.

Thank you for the advice, it's good to know i can sound off here & people do listen, just out of interest could anyone who has had the OR interview send me a post & let me know how their interview went? I would really appreciate the feedback. Thanks. Holly

Hi,

My OR interview was via a telephone conversation.

I initially received a letter from the OR's office informing me of the date and time the OR would phone me, the letter also mentioned that the interview could last for up to one hour and to have my 30 page bankruptcy application form (BAF) to hand to refer to during the interview. (The OR called me on the exact stroke of the arranged time!)
The OR asked me a series of questions as to how/why I had got myself into a bankruptcy situation, etc, and also clarified various points regarding my BAF...... what was the value of my car, did I need it for work, etc, etc.

The interview lasted about 30 minutes (I think) with the OR informing me that I could keep my car, as it was needed for my job. She also told me that I would be automatically discharged after one year.

The whole bankruptcy procedure was much, much less of an ordeal than I was imagining it would be, and the relief afterwards made it all worth it.

Thanks panason1c for your post, as i said in my earlier post i'm dreading the OR interview more than anything, especially what they will say re me using pay day loans when i'm not working & using my benefit money to pay them off, i suppose i deserve to get an ear bashing for doing it but as i said when you're desperate....

Bear in mind that the OR is a human being and has seen these scenarios many times. They will not judge you for using payday loans - lots of people have done so.

holly dont worry about the OR interview they are noton the creditors side or you side they just want facts and figures,im currently 6 weeks away from my discharge from bankruptcy and my road has beenfine because ive not had to think about all the debt i owe believe me going bankrupt was very straight forward for me,ive never had one phone call or letter from my OR in all the time ive been bankrupt,they dont judge you wether you just had loans or gambled the money they are there to make sure all the right things are put in place thats all,just think in your mind the creditors letters and phone calls will stop after about 6 weeks and although your credit rating will be pretty stuffed you can start your new road ahead in your life the day you go bankrupt,if you need advice contact viki who posted on this post she helped me with my bankruptcy if you need a friend whos been there with £43,000 debt you can contact me on here,trust me youwill feel better when you get things started

Worth mentioning that on receiving my bankruptcy certificate, I immediately sent copies of it to all of my creditors and I never heard from any of them since.

Good idea. I was abit more direct I rang each one and gave them the BR number and for those who didn't think the IR was legal enough a copy of the BR cert. Not bothered if they get the BR cert they can't do anything anyway and luckily my credit file is now sorted and on the way to recovery. I have to say I've passed more credit checks in the past month that I have in the past 10 years! - it's fab :)

Thanks for the advice guys, i'm feeling very down today, just in bad form i'm hoping i feel better when i'm declared BR & the OR Interview is finally done & dusted.I need some kind of closure cause the stress of this isn't helping my depression.

Totally agree with Niobe on this one.

don't fret! the OR interview is just to go through the forms you submitted. It really is nothing to fret about. Remember your paying them to do this for you, Don't feel like your in the wrong.

I'm out the other side by 6 weeks and I can honestly say it WAS the most sensible thing I have ever done. The relief hit me the second I walked out the court with my BR certificate in my hand!

We've all been where you are right now. I guarantee you it almost instantly gets better from day 1.
