I recently started to apply for a mortgage but noticed I had an involuntary bankruptcy on my credit file. I have now paid this off and apart from this bankruptcy my credit record is good. Due to having moved a few times in the last few years I did not receive the bankruptcy notice and the creditor has admitted that no warning regarding the bankruptcy was sent to me.
How long does it take to annul the bankruptcy through the court and do I need a solicitor? Time is of the essence as I need to get the mortgage for the house purchase and I fear that I may now lose the property due to this set back.
When was this bankruptcy put on the file? Did you make payments to the Official Receiver?
I would suggest that you speak to CAB or an expert to sort this out. The advice is free.
If you can annul it I imagine it will take a while.

Bankruptcy was put on file in 2012. The receiver who files the bankruptcy has now been paid in full. I have been told that the time taken to annul depends on when the court can fit me in for proceedings. Are there any fast track ways to do this? Can you recommend a solicitor service that specialises in these cases? Do credit companies act immediately to changes in bankruptcy status via the courts or are they a bit slow and need badgering?
I'm afraid I don't know of any solicitors but CAB should be able to help you out there.
As stated, you will probably have to rely on the courts fitting you in. If you get it annulled then the BR should be removed quickly. If not, then you can send a copy of the annulment to the relevant agencies and tell them to remove the BR.

Once the bankruptcy has been annulled you should send a copy of the paperwork to the credit ref agencies asking them to remove the entry ASAP. Hopefully they will be very quick but I would definitely speak to the sellers estate agents and explain what's happening so that hopefully, they will wait until all this is sorted.
