if i have a car on hp and have only paided one years off would the court make me give it back and can u keep current bank account if you have no overdraft and no cheque guarantee card

Hi

firstly I would recommend you check to see if your car is on HP or a Fixed Sum Loan agreement - these are different so please check and let us know. this may give you options.

secondly the closing of the bank account is down to the bank NOT the Official receiver. In fact many OR's will write to the bank for you and confirm that they have so problems with you keeping an account.

if it is the most basic account then you may well be OK - however banks such as HSBC will close it automatically.

can I suggest the COOP cashminder account. This provides you with a VISA Electron Card as well as basic banking.

If the agreement is one of hire-purchase - how long was it taken out over? If you have paid more than 1/3 of the overall payments, the hire purchase company will need a Court Order to enable the goods to be recovered, and if there is equity in the vehicle the OR may well want to see it sold for the benefit of the bankruptcy estate.
