Hi All, I was declared bankrupt on the 17/06/08 and have received a letter from my bank this morning demanding a payment of £423.88 to bring my visa account upto date even though they are aware i'm bankrupt. Can someone please tell me my legal position and whether or not they should have asked for this payment
One of the experts will be along soon (although its the weekend!) and be able to tell you but I think you should refer this direct to your Official Receiver (OR).

I was declared bankrupt on the 17/06/2008 but have received a demnd from my banks visa credit card this morning stating that even though they know i'm bankrupt they are demanding a payment of £423.88 from me or they will put this debt in the hands of a collection agengy. Can they do this and whats my legal standpoint please.
Inform the OR and let them deal with the creditor. They should not be asking you to pay money to them now, as the debt is included in the bankruptcy, but there is probably a delay in this information being shared with the collections department.

I agree with Melanie. The issue is that most lenders have huge administration departments, and sometimes it takes a little while for them to catch up with themselves. Just let the OR know and they'll deal with it.
