Hi just got made BR on Tuesday and will have a OR telephone interview next Thursday. After receiving my forms from OR I noticed that I have to find out all my actual balances to my creditors and when I last bought anything on credit from my various creditors. The two things I am worried about are I spent £400 on my next account 3 weeks before going BR and also bought a new cooker as my other one had broke 5 weeks before BR. What is the OR likely to say about this and what repercussions can I expect also does the OR know the date when you actually booked your BR hearing as I booked it a couple of days after spending. Many thanks if you can help me out. |

Hi Daisy, I dont think the OR is too fussed with what day you booked to go BR, so please dont worry. The cooker was an essential item but did you buy it with credit? From what I have gathered on here (I am yet to go BR), the OR doesnt look too kindly on spending just before BR on credit, but it also doent bear too much on the final outcome. Put it this way, you didnt spend thousands on Next, perhaps wasnt wise, but then was all the debt? We stopped paying creditors in May. In april I bought clothes on the Next directory for my children and also a £230 bed from the catalogue. My response to the OR will be "you dont realise that you REALLY have a problem until it smacks you in the face" and that is the truth. One day I woke up and the credit had gone. 48hrs later I found this site. Thats life! I think you'll be fine to be honest. Worse things happen at sea.....................

Hi there, Just be open and honest. Again you did not anticipate going BK when you bought the items (or did you know then) so I should not worry too much. The ORs as we read within these blogs are only human and as long as they are given the information as they ask for it and you did not deliberately contribute to extra credit debt and think to yourself I wont pay that then I sould think you will be fine. They dont like as DM said adding to extra credit debt just before, but if you explain it may make a difference, as they were essential to your needs. We too have a next and a littlewoods ac and added our last bits in dec last year I beleive it was and again for kids clothing etc. But like I have said dont worry just explain, the statements will show when and what you purchased and they are essential items and it was the only way you could get them at the time. For so long we have lived on credit and that was the only way we could get by per month and when it ran out and I ended up having a change of career the implications were not noticed till later. Im worried about how the OR will see ours but I know that if im honest and explain what happened hopefully they wont be too hard on us, it takes enough courage to have to admit the problem, then even more courage to have to decide you cant do it anymore and take the road the Bankruptcy. Just chill as my kids say and let the OR know when you speak to them, and dont worry about it. They will want to know if you knew when you bought it if you had intentions of going BK but as long as you were not insolvent when you took the debt so soon before the hearing date then within reason you should be ok. Again the OR will advise so jut wait to hear from the forum experts who no doubt will say my info is daft but they will be able to give the best advice for you. Take care Jo
