Hi,
Your site has been of imense help to us thank you.My wife and I are due to see the OR and Suzanne replied to a question with regard to a personel injury claim and Suzanne said that only loss of earnings in the claim would be of interest to the OR.
I have a possible clinical negligence claim from three years ago being investigated with no court date set so do I have to declare this to the OR and does the same condition apply with regard to loss of earnings from any damages received if successful.I do not want to risk perjury.Please help.

Hi

Because on the making of the bankruptcy order any asset or potential asset (including ongoing court proceedings) vest in the Official Receiver. You would be unable to pursue this further yourself and the OR would only do so if they were sure of a positive outcome. You may be able to get the OR to agree to you continuing your claim on the understanding you would account to them for any monies won.
