Hi all,
i am going BR. we are up in Scotland, and would appreciate any help or advice on the following-
1-we currently rent our house from my partners sister, would the AIB consider us to have an intrest (heritable intrest?) in the property? Is renting from a family member a problem when going BR??
2-We are not in arrears with the rent, and my partner is mortified that they will contact her sister and her whole family will know of my 'shame'. Will they/would they contact her?
3-i have been told i will need a copy of my lease for the house, which we dont have as its my partners sister and the agreement is, i suppose verbal? Should we get one draw up? or should it be ok to explain that the agreement is verbal?? will this cause further problems?
i understand the laws are slightly different up here, but any info on any similar situations would be greatly received!!

the experts on the site predominantly work with English & Welsh Insolvency law.
As you will know the laws in Scotland are different.
I for one cannot help I'm afraid but maybe one of the other experts, or members, may be able to.

Hi Bill,
Although the rules are slightly different in Scotland since the Laws have updated themselves to fall in line with that of England & Wales it is mainly terminology that differs.
1. Renting the property from a family member is not an issue, however to protect both yourselves and your sister-in-law I would have a tenancy agreement drawn up.
2. Unfortunately your sister-in-law is likely to be written too or contacted so it may be worth pulling her to one side now and filling her in on the situation.
