hi i.m new to this forum ...i am currently on iva but due to some unexpected turn out of event i will be applying for a br , my question is ... we(together w/ my wife ) have a mortgage , (my wife is not into iva)our mortgage is both in our name meaning she is co-ower as well ,if i file for a br ..does my wife needs to file as well ,eventhough hence started i was the one paying everything as she is not working ....hope somebody could give me a piece of advice about this ..tnx
If the house has equity then your wife could offer to buy the Benificial interest. If it is needed to be sold to release the equity to the creditors then if there is a shortfall in the sale then this would become due in full from your wife.
Hi, as far my knowledge, its not necessary that your wife need not file br. But in case of sales being done, then both you and your wife need to file br.
