Hi

1. What happens to child maintenaPlease could you answer 2 questionsnce payments when you are made bankrupt?
2. I am currently serving notice to be made redundant on 29/8/08. If I file for bankruptcy before this date, will my final salary be ceazed as an asset if I am able to pay it into my partners account?

Hi

You would still be required to pay child maintenance payments when bankrupt and they would be classed as an expenditure.
Your salary, whether it be the last one or not would not be classed as an asset as you would need it to cover living expenses. Any redundancy payments may be included as an asset.

Thank you Suzanne.

Any idea how much child maintenance would be due after redundancy and assuming I don't have a job to go to straight away? ie my only income being JSA.
Also would you be aware of any benefits I could claim in the short term?

Hi Richard

These are not questions I will be able to answer for you as they are not specific to bankruptcy and so not within my knowledge. You could try the benefits agency to see if they can help you in that area, and you would need to speak to whoever is collecting the child maintenance regarding that.
