My IVA failed on the 31st July and I go bankrupt this Friday (15th). Last night I had my first call from one of my creditors Capital One saying that I needed to make a full and final payment there and then. I explained about the bankruptcy and they said could I call them once it was done, I did say that the OR will be in contact with them... I am assuming that is correct?

It's been a year without any creditors calling and I certainly haven't missed it! I am expecting them all to start calling now!

I moved on the 4th July and as far as I am aware none of my creditors know my new address. Capital One said that a letter had been sent to my old address and I wasn't in a hurry to give them my new one.

What would happen? A member of my family still lives at the old address, would the bailiffs come round or is it far too soon for that?

Hi Maizie

Yes it's too soon for bailiffs.

The OR will contact them within a month of the bankruptcy to report on your assets and liabilities etc.

I should imagine its too soon for that, they need a court order for bailiffs which i think takes about 3 weeks. They are going to phone you and try to get some payment first, screen your calls to prevent unnecessary upset, i didn't answer most of them as the one company who i mentioned BR to threatened to start action via bailiffs and putting a charge on the house. But as you are petitioning on friday, i would imagine you are going to beat them to it, like i did.
