Hi there,
I am wondering and I dont think i have asked this before, but if we get a BRU or BRO do we still get discharged after the year.
The reason i ask is my mum wants to give me her car and allow me to insure in my name and said i could have it after we are discharged from Bankruptcy.
Can i do this after the year or do i have to wait till the BRU or BRO if we are given one expires. Im not too bothered if we get a BRO or BRU as i dont want CREDIT again look at the mess we are in now, I dont want another mortgage and I dont intend to become an MP or run a company.
Any advice please

Hi jo
if you get a BRU and discharged after 12 months as usual, then to transfer the car to you would be fine.

As you say, future credit and certain professions are pretty much what BRU's are about and for most
the effects aren't worth worrying about.

Hi John
Do you still get discharged after the 12months even if you have a BRU?
When would you not be discharged after 12months, any ideas?

Hi jo
with or without a BRU you are automatically discharged on the anniversary of your BR.
You should not expect to be notified.
Once discharged you can, if you wish, apply to the same court for your certificate of discharge which costs 60 pounds and takes about 2 weeks on average.

If the OR plans to impose a BRU or an IPA he has to do so before discharge. So if he wished to do either very late during the 12 month period he can apply to have your discharge postponed until the BRU or IPA is in place. It's not common for this to happen and in most cases due to you reporting that your I&E situation has changed for the better (income wise) and an IPA now becomes possible where it previously was not.

Hi John
Thanks again. I understand now, so I can def at the moment have mums car from the 4th of Aug 2009. Of course that depends on what the OR finds etc, im hoping that by then she would have made her mind up, she did say on the phone that as far as she could see at present we would be automaitcally discharged from the 4th so lets see what happens.
If you get a BRU after your discharged and want to rent a house do you have to tell the new landlords or rental agencies.

you don't have to tell anyone about having been BR or still being, if that's the case, in a BRU.

If you were to enter into any written agreement and the question was specifically asked then of course you should disclose truthfully.
A credit check by them will identify the fact anyway
