I wondered if you could help me as I am a little confused. I applied for bankruptcy in March 2006 and was discharged in October 2006. I did not pay into an IVA as I was unable to work at the time.

I have just received a letter from Revenue and Customs saying they have reviewed my tax affairs for 2005-06 and that a repayment has arisen. This money has been sent to the Official Receiver for benefit of creditors in my bankruptcy. Is this correct as the refund was for the year that I went bankrupt or should the money have come to me as I have been discharged. I thought the debts had been written off when I was discharged but also understand that the refund was for the period I applied for bankruptcy. Thanks for you help...

Hi Tammy and welcome to the forum. Unfortunately HMRC are right in sending the money to the OR, as any refund due for the period that you were BR does belong to them.
