Just a quicky - we're having to wait until we (both me & wife) go bankrupt as we don't have any money until I get paid what's owed to me from tribunal. In the meantime though we're now starting to get people instructing bailiffs.
Now, we've no assets that would be considered in bankruptcy, only 2 high value items are car (£300, old & rusty, required for work) and computer (looks high value but isn't, required for work, looking for work and conducting most of my life) - would the same be the case if the gits coming knocking?
Things like DVDs, telly (21" thing I got for free from my ex company) or anything else?
Just worried now, wife gives birth in 14 days (so anytime now) and this stress is making life unbearable for both of us :/ Thought to ask here as I'm sure many a bankrupt has had the indignity of these lawless idiots on their doorstep. |

Hi Syn, I cant answer that question as my creditors never got that far, we got there first. Maybe one of the others on here may have better advice, I had been verbally threatened and also written to threatening us with it that if i did not cough up but other than that no sorry. I hope someone can put your mind at rest. TTFN JO

Hi,
I am sure an expert will be along soon, in the meantime my understanding is as follows:
Only the court can instruct Bailiffs to attend your property, this would usually be for fines etc. The likelihood is that your creditors are threatening you with debt collectors. Debt collectors have no authority to enter your premises and certainly not to take your property, in fact my undrstanding is that you are not at liberty to even talk to a doorstep debt collector. The assets you mention would not be of interest in BR. If your creditors are getting heavy with you, tell them that you are planning to go BR but if they want to make you BR themselves then of course this would save you paying the court fee. Remember you are taking action for your debts and don't let your creditors bully you.

Thank you so much for that, all the advice helps. Had 2 heavy handed people call me today, the first was such a moron (from Moorcroft Debt collection agency) that he wouldn't even let me finish speaking - I'm disabled, have a severe stutter and before I could finish he interrrupted me and started blabbering legal mumbo jumbo. I gathered enough time whilst he was still speaking to advise him if he didn't shut up for 2 seconds, I'd hang up. I hung up, and writing to them today to say if they infringe my human rights like that again despite knowing my disability I'll have them up in court for a much larger sum than what I owe them. People need to learn to respect other people regardless of the context of communication - and I've already had one debt written off because the relevant company didn't think disabilities mattered.
Anyway, sorry about the brief rant, I find talking about these things even if only on an anonymous forum rather soothing and the advice given on here is second to none.
I'm now starting to think about borrowing £1000 to go bankrupt (both of us) from someone, probably family, but I wonder if that would be frowned upon when I finally get paid the large sum owed by my company that would then all get swallowed by the OR, so it looks like I should really wait and bear out all the morons and slightly more polite debt collectors. Not something I need - only 14 days before my wife gives birth! |

Synaesthesia welcome we all need to rant and this is the best place for ranting and advice. We are not going BR till 8th Sept the calls have become none stop at the minute only Barclay card leaving messages, I don't answer the phone at all as I don't think I could take the abuse I would probably get, today I got a call at work from HSBC he was off with me when I explained he was putting my job in jepody in the end I had to put the phone down, his last words were that this would not be the last call I receive at work, I have asked on many occasions for the number to be deleted but they don't. Hubby works away alot so I seem to get the brunt of everything. All I can suggest is not to worry to much as there is always light at the end of the tunnel. Do you know what sex the baby is? Is this your first? Sorry for so many questions?

Yeah, first baby, it's a boy :) Really looking forward to it.
Thankfully we've changed all our numbers now - owed money to mobile contracts so cut them off and gone Pay and Go. I've set up a temporary divert for one of my numbers just in case prospective employers still have the old number. That's the only reason this Moorcroft got through to me in the first place, so shouldn't be all bad. I just wish people who worked for those companies remember every now and then that they are also human at some point of their hard skins. The trouble is, the debt collection agents for one of my creditors is very local - if I ever get spoken to like I was today again, I'd end up being done for assault; and I'm the most docile person I know! |

Ahhhh a little boy, I remember when my son was born now he's sixteen and a stress head at the minute as the GCSE's are out on Thursday.He needs B's to go to college to engineering, he really wants to go in the RAF but he had a football accident in March and ended up with a plate and pins in his leg so I don't know what the chances are if he get's in the RAF.
A few weeks ago I answered the phone as the number was witheld and when hubby rings that is what comes up but it was a snotty lady from GE for hubby she went on and on I tried to explain that he was away with work and wasn't due back til 28th but would she listen NO! She insisted that I rang him and he returned her call urgently, I am unable to contact him only if it is life of death situation anyway she has rang twice a day since then do they ever listen, I wish I could just tel them that we are going BR but we are going to wait then hit them with the BR number and OR details.

Hey there, Just reading your blogs here, before we went BR i kep getting nasty and threatening calls from Robinson way debt collectors and also Barclays and Lloyds TSB. They just dont listen to you, i never told them that we were going to go Bankrupt as i did not want to tempt fate, but now we are so glad that we did it. The very occasional letter from them which i place in an envelope to send to the OR once a week and no more calls as all our numbers had been changed as we too were on contract and then went to PAYGo. Our home number is Ex dir so they cant get that one and soo no calls to us on there either. Its a really stressfull time for all esp when your pregnant, good luck Syn with your forthcoming arrival, I have 3 boys 1 whos 15 which learning disabilities and twins that are 9 this year, ALL BOYS. I have my work cut out but somehow I manage. I did get a bit stressed the other day as Ann knows but i am feeling much better, my life is getting back on tracck and hubby suggested i do a home job, good idea but slightly defeats the object of getting out and having a life, never mind at least he is thinking of others now not just himself. Im having a treat today, my hair cut and hi lights I need the boost! Anyhow all time to go, I will be back later Jo
