Hi, I am probably going to be going Bankrupt in the next couple of months. I split up from my wife (fairly amicably) around 4-5years ago and at the time we agreed that I would make maintenance payments of £500/month. After around a year we reduced this to £450. This amount has been paid monthly to date and is clearly shown on my monthly bank statemetns. We were divorced last year. My question is as this was not arranged through the CSA or anything formal, would the official receiver allow me to continue making these payments? Thanks.
Hi Thirteen Welcome to the forum. From what i understand YES you will be able to continue making the payments for your maintanence. It may be required that something be done in writing to show that this money that goes out is of course for that, maybe a letter from your wife to say that this is what the money is used for. I have a CSA debt that we have to pay and it went on the form known as The Statement of Affairs that you give in when you declare BR and that bill still has to be paid. So I am assuming im right as its a different type of debt, you may as I have said just have to get more info for the OR to show it etc. Hope I have helped, one of the experts or other members will also be able to advise if im not 100% accurate but hang on in there.
