I thought that i would have to miss 3 payments on my IVA before I could go BR but just spoken - again - with my IP's manager and it looks as thought they will be willing to issue a Certificate of Failure way before. Just sent a letter to them in the post as they requested to confirm that i want it cancelling. I'm waiting for this guy to phone me back, he's gone off to listen to the calls that i made at the beginning of the IVA process, i think they may be panicking a little as it seems as though i have been mis-sold an IVA and as i said to this guy looking back at it all it seems as though they were trying to get the payment for the IVA to fit my budget rather than looking at my finances realistically. Especially as i do remember having conversations regarding clothing and other essentials but none show up on my I&E sheet.

Think i had better start looking at those forms for the court a bit sooner than i thought

Thanks John for the advice you gave earlier on the phone it really was helpful, i may have more questions sooner than i thought earlier!!!

as per our chat earlier, I feel the IVA has indeed been mis-sold.
That's likely the reason why he may be prepared to look at ways to issue the Certificate early.

God knows what the creditors will think of the IP though!!!

Fingers crossed you can get this all over with sooner than expected.

Hi all

I hope it can all get moving a bit faster. Must admit i am feeling much better now and after reading through a lot of the info on here and other people's experiences i'm not too worried about the whole process. I'll try and deal with each thing as it comes along instead of worrying about the unknown.

I hope lots of other people on here can be positive and see the whole process as a step forward and a whole load of weight lifted off even when things do seem bleak.

I've got all the info as well for making complaints re the IVA and the ombudsman etc, etc, I think that i will definitely go through that process as well as although it won't really help me but it might just stop it happening to someone else and somme good will come out of it all.
