hi everyone My husband and I were made BR today so I thought I would share our experience. We had at an appointment at 9.30 yesterday, got scanned through the security barrier and because were were early had to wait about 1/2 hour in the waiting room. Because the cashiers didn't open till 10 we had to dial through and use the phone to let a clerk know we were there. before we put the phone down someone had alreay come over to take us to the counters. The lady was very nice and polite, and asked us if we both had our 3 copies of the petition (which we had) and then she asked for the fee and counted it! She confirmed a couple of details and made some small amendments. she asked if we wanted to swear on the bible, but we just read a short script instead- just basically to confirm that we are who we say etc and what we have written is true etc. We then signed each of the copies.
The next part was scheduled for today(this is our locl court's standard procedure) at 10am. Again we arrived early. We went to the first floor to the ushers desk and he said that he would call us when the judge was ready and that when we were done that he would give us a file each and then have to walk downstairs where we had been yesterday to have the paperwork completed, and he confirmed that we wanted to be seen together. We were called at 10.20 into a small room with a desk. The judge was sitting down and asked us to do the same. I thought to myself that he looked a bit grumpy at the time! He basically said that he had looked through our forms and he asked us if we had taken any advice before coming to this decision. He queried that most of our 60k debt was because of negative equity leaving only about 15k in unsecured borrowing. This was correct and he asked us if we had any family who could help us because he felt that this was a small amount of money in the grand scheme of things. We explained that we had no family that were able to help and that we could not afford the mortgage etc and that we know it is also due to go up soon.By this stage I was panicing slightly because I thought that he was considering not making the order. I guess that on paper it looks like a small amount but after we explained he saw that we were insolvant and we explained that we could not do an IVA etc. He then stamped and signed the orders and he said that if we came into money from family etc or via work that we may be able to consider getting the BR annulled in the future. we said that this was most unlikely and then he said that he hoped that things would get better for us. We thanked him for his time and then went downstairs. The clerk printed out our BR certs and pointed out our BR numbers to us and the OR address and tel number. She said that the OR would be in contact either the end of this week or the begining of next.
I had mixed feelings when we left the court. This isn't what I thought would happen in my life, but I am hoping that it could be one of the best things that I have done or at least a turning point for a fresh start.Sorry for the long post but I thougt that it may help people who may be worried about the court. Its not as bad as you think, I wish it could have all been done in 1 day though (like most other people seem to say has happened to them!) as I had a sleepless night inbetween! I can hopefully sleep a bit better tonight!
Thank you to everyone, one step over and done with! Christina |

Hi christina
I hope you have a few glasses of wine (cheap of course!) and a good night's rest.
