Hi we are hoping to go BR very soon and hubby has had a very disturbing conversation today.
He was told by a work colleague that having been discharged, Barclays are still trying to recover the debt.

Has anyone heard of this happening? I thought that once declared BR, unless there's an IPA/IPO there's nothing to pay, certainly not directly to the creditors?

I'm trying not to worry as it's only hearsay, but hubby is quite concerned!

As far as i am aware they cannot do that. The debt would have been included as long as it was on the SoA and so it would be gone and the creditor cannot try and get monies again.
If the debt had not been included then of course they can chase you.
If that were me i would have contacted the OR and informed them, or write to the company with an old copy of the BR form and hopefully that will get them off their backs.
Strange though, but i dare say some companies will still try it on.

The bigger the company the more complicated the paperwork trail,

Incidentally it is illigal for a Br to repay a debt included in a Br. Additionally any debt in br is written off so I would suggest your friend refer BC to the official receivers and also send them a copy of the Br order.

hi jo,

it's not too bad just fed up with all the phone calls! Can't wait to get it done now and start counting off the months on the calendar until discharged.

Got to be honest though, I am quite enjoying not having available credit - its so liberating knowing that whatever I spend is actually my money and not the credit card's!

Christmas will still be difficult but a challenge I'm looking forward to....

Hi me too, like you i dont really know how we managed before, we get so used to using credit that it becomes a way of life, then suddenly it stops and wow the feeling of being able to manage again all comes back.
Its a case of we can do it and it so much more satisfiying like you said knowing the money your spending is yours.
I know what u mean about christmas but hey its not what you give or receive its about family and being there and my kids know this year that they may not get as much as santa has asked us to help to buy some and we said that means not so much.
Thats worked so far for me.

I still get the occasional letter from creditors, one month on from BR.

Both the OR & myself have written to these companies, but I guess it just takes a while for the penny to drop.

Letter in, Shred, Normality.

Yeh I'm fine thanks Jo, it's been a month already - gone so quick!

Lloyds is the only creditor that are still sending stupid letters, despite me sending a copy of the BR order.

Yeah we are getting there, i cant believe a month has gone by already. I have been adding usefull information to my blog.
Anything i find usefull i add in, like links to other sites for helping with the needs and effects of bankruptcy.
I have been having fun on there too. Adding pics etc.
Ours has been just over 5 weeks now.
All good though.

Oh and forgot to mention why not take a copy of your BR letter to the main bank.

I did that stopped the letters from Lloyds.

Hi Jo,

Glad you're getting on fine too. It seems really weird to not have to worry about making sure X account has enough credit for a DD etc.

As for Lloyds, I did send a copy to my branch and it's the "airmiles credit card" division that keeps hounding me. Maybe they don't deal with this department and I need to send one off to those.
