Hello Everyone

Some of you may recall from my postings a month or so back that i was considering bankruptcy. Armed with all the facts and putting things in my life into perspective, i decided that it would be the best option for me and my fiance and our future. I have since filled out the necessary forms and am awaiting my court hearing which has been booked in for 17th October at our local courts.

The problem is that this is quite a way off, apparently the courts are really busy. Since obtaining a hearing date i have openly told my creditors that i am going bankrupt and given them the date and court location etc, and to be fair most of them have been understanding and just call once a week for an update.

However Barclaycard have referred me to Mercers and because i am unable to pay them anything in this interim period, they have today told me that they are reffering me to Dooer Step Collections.

This is worrying me and i was wondering if anyone hear could advise me on what will happen when my door gets knocked? Will they force entry into my home? What if i am not in? Me and my fiance live at my parents home (mum turned upstairs into a 'flat' for us) and i dont want my mums stuff getting conviscated.

I dont have any money to give Mercers/Barclaycard - and it would be really heartbreaking to lose our furniture etc - do i have any rights when muy door gets knocked? What should i say? Do i have to give them anything?

I am just counting down the days and the stress lifts a little every day i get closer to 17th October, i am just really worried about what will happen with this door step collection

Hi

If they send doorsstep collection agents round get them to come in and have a cup of tea and tell them you are going br in Oct. They will leave without finishing the tea.

A debt collector is very different to a Bailiff. a debt collector is just the same as a phone call but at the door. They have absolutely no authority to take anything whatsoever.

Even if you received a blue & white County Court Judgement form tomorrow morning there is insufficient time to get a bailiff involved so I can't see a problem.

Try not to panic Tifosi, I was in the same situation as you only 5 weeks ago.

Nationwide (one of my biggest creditors) kept sending letters saying that they're disappointed that I'm not keeping in contact and/or making token payments. The last 3-4 letters stated that my debt has been referred to KPMG, who will knock on my door for "collection".

After phoning Nationwide, the lad on the phone told me that the letters are all computer-generated, and as I'd already advised them I'm going BR, nobody will call - and they never!

Hi Tifosi

Paul from Reviva is so correct.I had a debt with Littlewoods about 4 years ago they threatened sending a door stop collector around.After a year of threats a little old man of 70 turned up and said how much could I pay.Ended up paying £6 a week.

Bailifs are different.The case would have to go to court, and you ordered to pay a set payment to the creditor.Then if you didnt keep up that payment the creditor could go back to court to ask if they could then ask the Bailifs to collect.

Bailifs are a long way at the end of a long road when a creditor is chasing a debt!!

Hi i had letters and calls from these companies saying that if i did not pay i would expect a visit in days, well weeks went by and all i kept getting was the same letters and same phonecalls.

No one came to the door.
